About K-1 Fiancé Visa

In order to obtain a K-1 fiancé visa, a U.S. citizen has to file a fiancé petition on behalf of his or her foreign born fiancé. Upon approval of the fiancé petition and completion of all the required forms, a U.S. consulate or embassy in the fiancé’s home country will interview the foreign fiancé. Based on the results of the interview, the consular officer will issue a K-1 visa for the foreign fiancé and a K-2 visa for the fiancé’s children. When the foreign fiancé arrives in the United States, the marriage should take place within 90 days of the fiancé’s arrival, otherwise the foreign fiancé must leave the United States.

A foreign fiancé who marries a U.S. citizen fiancé can apply for a Green Card (officially called a Permanent Resident Card) which will allow him or her to permanently stay and work in the United States. In order to apply for a Green Card, the spouses must prepare and file all the necessary documents for a Green Card Application (officially called Adjustment of Status Application).
